Attorney Elisha Ongoya made a compelling appeal to Kenya’s Judiciary on October 29, seeking to overturn the impeachment of Deputy President Rigathi Gachagua. Speaking before the court, Ongoya cast the Judiciary as the final arbiter in what he described as a crucial test of constitutional governance.
“I bring a message of hope,” Ongoya declared, acknowledging public concerns while framing the impeachment challenge as an opportunity to strengthen democratic institutions. He emphasized that the court’s intervention could serve as a corrective measure following the National Assembly and Senate’s decision to remove Gachagua from office.
The attorney positioned the Judiciary as a potential balancing force in Kenya’s governance structure. He argued that the court system stands uniquely positioned to address what he characterized as institutional missteps by other government branches.
Reflecting on recent governmental actions, Ongoya urged the court to seize this opportunity to uphold constitutional principles rather than “perpetuate wrongs.” With both legislative houses having confirmed the impeachment, he emphasized that the Judiciary represents Gachagua’s final recourse for justice.
“Our remaining beacon of hope is this Judiciary,” Ongoya stated, highlighting the significance of the court’s impending decision. The case’s resolution could establish important precedents for future legal challenges involving senior government officials’ impeachment proceedings.
